Legal disputes can quickly become complex, especially in the USA. Jurisdiction, procedures, cost risks, and the roles of the police, prosecution, insurance companies, and courts differ in essential ways from the structures familiar in Germany. Furthermore, law in the United States is largely regulated at the individual state level. Therefore, what applies in Florida can be judged differently in California, New York, or Texas.

What are typical legal problems during a stay in the USA?

Why is quick action crucial?

Whether insurance coverage exists cannot be answered generally. The individual insurance terms and conditions, the specifically agreed-upon legal protection module, and the nature of the legal problem are always decisive. Private, traffic, criminal, or damages legal protection may be particularly relevant.
To be examined, among other things:
- whether the territorial scope includes the USA
- whether the stay was only temporary or is to be classified as a permanent stay abroad
- whether the affected legal area is insured
- when the claim occurred
- what waiting periods, deductibles, and sums insured apply
- The exclusions that apply, for example, in cases of intentional offenses or certain professional activities
- and whether the insurer requires a confirmation of cover before engaging a lawyer
Legal protection insurance does not regularly cover „every“ legal dispute abroad. The coverage of criminal defense costs also depends heavily on the policy and the charge. For example, if an insured person is reliably proven to have committed an intentional offense, insurers may be released from their obligation to pay or may demand repayment of costs already paid, depending on the terms and conditions.
Conversely, an initially rejecting response from the insurer does not necessarily mean that there is no insurance coverage. In practice, it happens that coverage requests are worded too generally, the facts are presented incompletely, or individual clauses are not classified correctly. Therefore, a careful review of the insurance policy, the general legal protection conditions, and the specific rejection can be useful.
How to properly prepare a letter of commitment?
Before engaging a lawyer, and as far as the situation allows, a coverage inquiry should be submitted to the legal protection insurance. A precise representation of the facts is important. The insurer regularly requires information about the event, the location, the persons involved, official measures, and any existing documents.
In cases of immediate criminal or police action, prompt legal assistance may be required. In such situations, the coverage request should be prepared concurrently, and the urgency should be documented with the insurer.
A legal review can clarify, in particular, whether the insurance company's rejection is justified, whether a supplementary explanation or complaint is likely to be successful, and what costs may initially have to be borne by oneself.
Representation in the USA and collaboration with local attorneys
Effective representation in the United States regularly requires knowledge of the respective federal state law and, if necessary, the involvement of a locally licensed attorney.
